Rain or Shine Terms

This engagement will proceed on a Rain or Shine basis. Sapphire Entertainment’s standard 25% non-refundable deposit will be required to secure the engagement.

The Purchaser is responsible for providing adequate overhead shelter to protect the Artist, personnel, instruments, sound equipment, and electronics from rain and other weather conditions. The performance area must be sufficiently covered and protected from wind-driven or blowing rain entering from the sides, and the floor or ground beneath the performers and equipment must remain dry and protected from water intrusion.

Even when shelter is provided, the Artist reserves the right to delay, suspend, or discontinue setup or performance if rain or moisture enters the performance area, lightning is present, or other weather conditions create a safety risk to performers, crew, patrons, or equipment. The Artist reserves the right to determine whether the performance area and conditions are safe for performers, crew, instruments, sound equipment, and electronics.

The Artist is under no obligation to alter, extend, delay, or otherwise shift the contracted performance time or performance window to accommodate the timing, arrival, departure, or anticipated improvement of weather conditions. Any change to the contracted performance schedule is subject to the Artist’s availability and mutual agreement of the parties.

Weather-related delays, interruptions, or cancellation of the performance do not relieve the Purchaser of the payment obligations established in the Entertainment Agreement.

Inclement Weather Cancellation Terms

If the Purchaser elects not to make the engagement Rain or Shine, a 50% non-refundable deposit will be required to secure the engagement.

The Purchaser may cancel the engagement due to forecasted inclement weather at least eight (8) hours before the scheduled performance start time. If timely cancellation is made under this provision, the remaining contract balance will not be due; however, the deposit remains non-refundable.

If the Purchaser does not cancel the engagement at least eight (8) hours before the scheduled performance start time, the engagement will thereafter be considered Rain or Shine, the remaining contract balance will be due in accordance with the Entertainment Agreement, and the following provisions will apply:

RAIN DATE / RESCHEDULING

Any agreement to reschedule the engagement to a rain date or other alternate date is subject to the Artist’s availability and mutual agreement. A rescheduled performance will be considered a new engagement and will require a new contract. Any deposit paid under the original agreement will not be transferred or credited toward the rescheduled engagement. At Sapphire Entertainment’s discretion, the performance fee and/or deposit for the rescheduled engagement may be reduced or waived based on factors including the parties’ relationship, the rescheduled date, Artist availability, and other circumstances. Any such accommodation will be determined on a case-by-case basis and must be agreed upon in writing.
